Taajama Online – Terms of Use, Test Program Terms and Privacy Policy

1. General

Taajama Online is a browser-based city-building game developed by Mika Peltomaa and published by Phenomenal Cellar Studios (part of Phenomenal Development Oy).

The game is currently in an early test phase (Early Access / Alpha). Access is granted only with a separate invite code.

By using the game you accept these terms of use in full.

If you do not accept the terms, do not use the game.

The Service is a browser-based city-building game in which the User builds and manages a virtual town (taajama) and follows the lives of its residents and the development of the town.

The Service is an automated online service: the game progresses and the simulation runs independently without continuous personal maintenance.

The Service is currently provided free of charge in a closed test phase. Paid digital products may be added to the Service later (see section 14, Purchases, cancellation and refunds).

4. Eligibility and age limit

A user of the Service must be at least 13 years old.

If the User is a minor (under 18 years old), use of the Service requires the consent of a parent or legal guardian.

A minor's use of the Service is the responsibility of their parent or legal guardian. The guardian is responsible for ensuring that the minor complies with these terms, as well as for any purchases the minor may make in the Service.

By using the Service, the User affirms that they meet the above age and consent requirements.

5. Nature of the test version

Taajama Online is unfinished software.

The game's features, content, game mechanics, user interface, balance, graphics, services and availability may change at any time without prior notice.

Phenomenal Cellar Studios does not guarantee that:

The game's content may be changed, removed or reset partially or entirely during testing.

6. User accounts

Using the game requires a user account.

The player undertakes to provide correct and up-to-date information.

The User is responsible for keeping their account credentials confidential and for all activity that takes place on their account.

The User may delete their user account at any time from the Service's settings (⚙️ Settings → Delete account) or by contacting mika@phenomenal.fi. Deleting the account ends use of the Service and removes the personal data associated with the account, unless legislation requires it to be retained.

Phenomenal Cellar Studios may close a user account without prior notice, for example in the following situations:

7. Invite codes and participation in the test program

Taajama Online is a closed test version, accessible only with a valid invite code.

Invite codes are personal unless Phenomenal Cellar Studios has separately stated otherwise.

Selling, renting, publicly sharing or otherwise distributing an invite code without authorization is prohibited.

Phenomenal Cellar Studios may revoke an invite code or remove test access without prior notice if the invite code is used in violation of the terms or in a way that disrupts the game's testing activity.

Phenomenal Cellar Studios reserves the right to accept or reject participation in the test program, and to restrict or end an individual user's access to the game at any time without separate justification.

Participation in the test program does not create any right for the player to the game's future versions, features, benefits or other services, except in those situations that have been separately communicated to the recipient of the invite code.

8. Intellectual property rights

All rights related to Taajama Online belong to Phenomenal Cellar Studios or their respective rights holders.

These include, among others:

Taajama Online, its game mechanics, user interface solutions, graphics, content, world, name, identifiers and other elements related to the game are the property of Phenomenal Cellar Studios.

Copying, reproducing, decompiling, modifying, redistributing, selling or commercially exploiting the game or its parts without written permission is prohibited.

Reverse engineering of the game, determining the source code, or copying the game's technical solutions is prohibited.

Exploiting the game's content or solutions, in whole or in part, to develop a competing or similar product is prohibited.

9. Publishing game material

Phenomenal Cellar Studios grants testers permission to publish:

Phenomenal Cellar Studios may request the removal of material for a justified reason.

10. Ideas and feedback provided by players

Players may submit ideas, suggestions, feedback or other content related to the game.

By submitting an idea or feedback, the player grants Phenomenal Cellar Studios a permanent, worldwide, royalty-free and irrevocable right to use, develop, modify, publish and exploit that content as part of the game or other products.

The player does not acquire any right to compensation or ownership of features added to the game.

Phenomenal Cellar Studios aims to acknowledge ideas that influenced the game's development by later publishing a credits list together with the game.

The name or alias of the person who submitted an idea may be added to the credits.

11. Acknowledging testers

Phenomenal Cellar Studios may publish, together with the game, a list of people who participated in testing.

A tester's name or alias may be added to the credits.

If a tester wishes to use a specific alias, or does not want their name published at all, this must be communicated by email to: mika@phenomenal.fi

12. Prohibited use

Taajama Online is intended to be used only through the game's normal user interfaces and the functions provided by Phenomenal Cellar Studios.

The player must not:

If a player notices an error, security issue or other anomaly in the game, they are encouraged to report it to the development team and not to exploit the finding for their own benefit.

Phenomenal Cellar Studios reserves the right to delete a user account, revoke test access or block access to the game immediately if these terms are violated.

13. Virtual property

All in-game content, including buildings, resources, achievements, statistics, game characters, in-game currency and other virtual items, is part of the service.

The player does not acquire ownership of any in-game content.

Phenomenal Cellar Studios may change, remove, rebalance or reset the game's content at any time without any obligation to compensate.

14. Purchases, cancellation and refunds

Products sold in Taajama Online are digital content (for example in-game currency, features or other electronically delivered content).

When you make a purchase, delivery of the product begins immediately after the purchase is confirmed.

Because the product is a digital product whose delivery has begun immediately after purchase, the purchase has no right of cancellation or refund, and you are not entitled to a refund.

At the time of purchase you expressly agree that delivery of the product begins immediately and that you lose the statutory right of withdrawal under consumer protection law once delivery has begun.

A separate notice about this is always shown at every point of purchase before the purchase is confirmed.

15. Availability and support

The Service is an automated online service. The Provider keeps the Service available to the best of its ability, but does not guarantee that the Service is available without interruption or free of errors.

The Service may experience interruptions, for example due to maintenance, updates, technical faults or reasons beyond the Provider's control.

For questions about the Service you can contact mika@phenomenal.fi by email. The Provider aims to respond within a reasonable time but does not guarantee any specific response or resolution time.

16. Limitation of liability

The Service is provided "as is" and "as available", without any express or implied warranties of any kind.

The Provider does not warrant that the Service is suitable for the User's particular purpose, nor that the Service is error-free, uninterrupted or secure.

The player uses the Service at their own risk and is responsible for their own internet connection, hardware, software and information security.

The Provider, Mika Peltomaa or other parties involved in developing the game are not liable for any indirect or consequential damages, such as loss of data, service interruptions, loss of benefit or business losses, related to the use of the Service or the inability to use it.

Nothing in these terms limits the Provider's liability to the extent that it cannot be limited under mandatory law (for example intent, gross negligence or mandatory rights under consumer protection legislation).

17. Privacy and data location

Taajama Online stores and processes user data to enable the operation of the game.

Data that may be stored includes, for example:

Game events may be stored for quality control, troubleshooting, security, analytics and game development.

The Service's servers are located within the European Union (EU/EEA), and data is stored and processed within the EU/EEA. The Provider protects personal data with appropriate technical and organizational measures.

Cookie management (CookieYes)

For managing cookie consent we use the CookieYes cookie consent platform (cookieyes.com), which handles the cookie consent required by the GDPR: it displays a cookie banner on the public pages, collects and stores your consent, and lets you change or withdraw your choices at any time.

You can accept or reject non-essential cookies (such as analytics) from the cookie banner, or change your choices later from the site's cookie settings.

Web analytics (public marketing pages)

The game's public marketing pages (e.g. the front page at taajamaonline.fi) use Google Analytics visitor analytics to understand visitor numbers and site usage and to develop the service. Google Analytics is not used in the game itself (behind login).

Google Analytics may set cookies and process data (such as IP address and browser information) also outside the EU. You can prevent tracking via your browser settings or privacy-protecting add-ons.

Data is not sold to third parties.

Data may be disclosed to authorities where required by law.

A player may request to access, correct or delete their own personal data by contacting mika@phenomenal.fi.

18. Changes to and discontinuation of the service

Phenomenal Cellar Studios may at any time:

19. Applicable law and consumer rights

These terms of use are governed by the laws of Finland.

These terms do not limit the rights that belong to the User as a consumer under mandatory law. If any term conflicts with mandatory consumer protection legislation, the mandatory legislation prevails.

Any disputes shall primarily be resolved through negotiation. If no settlement is reached, the matter shall be resolved by a competent court in Finland.
