Taajama Online – Terms of Use, Test Program Terms and Privacy Policy

1. General

Taajama Online is a browser-based city-building game developed by Mika Peltomaa and published by Phenomenal Cellar Studios (part of Phenomenal Development Oy).

The game is currently in an early test phase (Early Access / Alpha). Access is granted only with a separate invite code.

By using the game you accept these terms of use in full.

If you do not accept the terms, do not use the game.

2. Nature of the test version

Taajama Online is unfinished software.

The game's features, content, game mechanics, user interface, balance, graphics, services and availability may change at any time without prior notice.

Phenomenal Cellar Studios does not guarantee that:

• the game runs without interruption;
• the game runs without errors;
• game saves are preserved;
• the game's features remain unchanged;
• the game services are continuously available.

The game's content may be changed, removed or reset partially or entirely during testing.

3. Player responsibility

The player uses the game entirely at their own risk.

Phenomenal Cellar Studios, Mika Peltomaa or other parties involved in developing the game are not liable for any direct or indirect damages, losses, costs, loss of data, service interruptions, business losses, equipment failures or other consequences related to the use of the game or the inability to use it.

The player is responsible for their own internet connection, hardware, software and information security.

4. Intellectual property rights

All rights related to Taajama Online belong to Phenomenal Cellar Studios or their respective rights holders.

These include, among others:

• the game's software;
• source code;
• game mechanics;
• graphics;
• user interfaces;
• logos;
• names;
• texts;
• sounds;
• databases;
• the game's content as a whole.

Taajama Online, its game mechanics, user interface solutions, graphics, content, world, name, identifiers and other elements related to the game are the property of Phenomenal Cellar Studios.

Copying, reproducing, decompiling, modifying, redistributing, selling or commercially exploiting the game or its parts without written permission is prohibited.

Reverse engineering of the game, determining the source code, or copying the game's technical solutions is prohibited.

Exploiting the game's content or solutions, in whole or in part, to develop a competing or similar product is prohibited.

5. Publishing game material

Phenomenal Cellar Studios grants testers permission to publish:

• short gameplay videos;
• screenshots;
• streams;
• promotional material about the game;
• discussion and marketing concerning the game.

Publishing does not, however, grant the right to:

• copy the game's content;
• use the game's material in your own products;
• publish the game's source code;
• publish the game's technical implementations;
• publish database structures;
• create copies of the game or derivative works.

Phenomenal Cellar Studios may request the removal of material for a justified reason.

6. Ideas and feedback provided by players

Players may submit ideas, suggestions, feedback or other content related to the game.

By submitting an idea or feedback, the player grants Phenomenal Cellar Studios a permanent, worldwide, royalty-free and irrevocable right to use, develop, modify, publish and exploit that content as part of the game or other products.

The player does not acquire any right to compensation or ownership of features added to the game.

Phenomenal Cellar Studios aims to acknowledge ideas that influenced the game's development by later publishing a credits list together with the game.

The name or alias of the person who submitted an idea may be added to the credits.

7. Acknowledging testers

Phenomenal Cellar Studios may publish, together with the game, a list of people who participated in testing.

A tester's name or alias may be added to the credits.

If a tester wishes to use a specific alias, or does not want their name published at all, this must be communicated by email to: mika@phenomenal.fi

8. Invite codes and participation in the test program

Taajama Online is a closed test version, accessible only with a valid invite code.

Invite codes are personal unless Phenomenal Cellar Studios has separately stated otherwise.

Selling, renting, publicly sharing or otherwise distributing an invite code without authorization is prohibited.

Phenomenal Cellar Studios may revoke an invite code or remove test access without prior notice if the invite code is used in violation of the terms or in a way that disrupts the game's testing activity.

Phenomenal Cellar Studios reserves the right to accept or reject participation in the test program, and to restrict or end an individual user's access to the game at any time without separate justification.

Participation in the test program does not create any right for the player to the game's future versions, features, benefits or other services.

9. Examining, automating and misusing the game

Taajama Online is intended to be used only through the game's normal user interfaces and the functions provided by Phenomenal Cellar Studios.

The player must not:

• use bots, scripts, macros, AI agents or other automated methods to play or to perform the game's functions;
• collect data from the game automatically, including mass downloading, indexing, scraping or other similar activity;
• examine, analyze or attempt to determine the game's source code, database structure, server environment, interfaces or other technical implementations;
• decompile, reverse engineer, modify or reproduce the game or its parts;
• use software or methods intended to circumvent the game's technical restrictions or protections;
• disrupt the operation of the game servers, intentionally overload the service, or attempt to affect other players' user experience;
• exploit errors, software bugs or other anomalies in a way that gives the player an unfair advantage or could cause harm to the game or other users.

If a player notices an error, security issue or other anomaly in the game, they are encouraged to report it to the development team and not to exploit the finding for their own benefit.

Phenomenal Cellar Studios reserves the right to delete a user account, revoke test access or block access to the game immediately if these terms are violated.

10. User accounts

Using the game requires a user account.

The player undertakes to provide correct and up-to-date information.

Phenomenal Cellar Studios may close a user account without prior notice, for example in the following situations:

• breaking the rules;
• harassment;
• cheating;
• misuse of the game;
• disrupting the operation of the service;
• circumventing technical protections.

11. Virtual property

All in-game content, including buildings, resources, achievements, statistics, game characters, in-game currency and other virtual items, is part of the service.

The player does not acquire ownership of any in-game content.

Phenomenal Cellar Studios may change, remove, rebalance or reset the game's content at any time without any obligation to compensate.

12. Privacy

Taajama Online stores and processes user data to enable the operation of the game.

Data that may be stored includes, for example:

• name;
• alias;
• email address;
• login data;
• in-game event data;
• technical log data;
• IP addresses;
• browser and device information.

Game events may be stored for quality control, troubleshooting, security, analytics and game development.

The game servers are located in Finland.

Web analytics (public marketing pages)

The game's public marketing pages (e.g. the front page at taajamaonline.fi) use Google Analytics visitor analytics to understand visitor numbers and site usage and to develop the service. Google Analytics is not used in the game itself (behind login).

Google Analytics may set cookies and process data (such as IP address and browser information) also outside the EU. You can prevent tracking via your browser settings or privacy-protecting add-ons.

Data is not sold to third parties.

Data may be disclosed to authorities where required by law.

A player may request to access, correct or delete their own personal data by contacting mika@phenomenal.fi.

13. Changes to and discontinuation of the service

Phenomenal Cellar Studios may at any time:

• change the game;
• suspend the service;
• remove features;
• close user accounts;
• discontinue the game entirely.

The player does not acquire any right to compensation in such situations.

14. Applicable law

These terms of use are governed by the laws of Finland.

Any disputes shall primarily be resolved through negotiation.

If no settlement is reached, the matter shall be resolved by a competent court in Finland.
